Tenant's Windows Sealed During Neighboring Construction

Tenant complained of a reduction in services after her apartment windows were sealed. The DRA ruled for tenant and reduced her rent. Landlord appealed, arguing that the window blockage was caused by new construction next door to landlord's building. The DHCR ruled against landlord. The DHCR inspection showed that the living room and dining room windows had been sealed because of construction facing these windows. It didn't matter why the windows were sealed or who sealed them. Landlord was responsible for providing required services to tenant.
