Construction Dust During Apartment Renovation Wasn't Minor Condition

Rent-stabilized tenants complained of a reduction in building-wide services based on building conditions during landlord’s renovation of the building. The DRA ruled for tenants and reduced their rents. Landlord appealed and lost. Landlord claimed that the conditions were temporary and de minimis. During work hours, janitorial service was lacking in the first-floor hallway. And the DHCR’s inspector observed insufficient precautions to minimize construction dust emanating from the gut renovation of two apartments.
