Tenant's Girlfriend Occupied Rent-Controlled Apartment

Landlord applied for a 10 percent increase in rent-controlled tenant's maximum rent based on increased occupancy. The DRA ruled against landlord because it found that the additional occupant in question was tenant's spouse. Landlord appealed, claiming that when it filed its application, the occupant was still tenant's girlfriend and not yet his wife. The DHCR ruled for landlord. During the five-month period between the first rent payment dates after landlord filed its application and before tenant got married, landlord was entitled to the requested rent increase.
