Rent Increased for Third Successor to Rent-Controlled Apartment

Rent-controlled tenant complained of rent overcharge. Tenant was the third family member successor tenant of the rent-controlled apartment. He claimed that landlord improperly raised the rent from $1,327 to $1,743 when the apartment was passed on to him. The DRA found that landlord was entitled to a 49.4 percent rent increase. Tenant appealed and lost. Landlord was entitled to collect a 20 percent vacancy allowance plus a longevity allowance of 29.4 percent, representing 49 years x 0.6 percent.
