Tenant's Consent Needed for Rent Increase for New Stove

Tenant complained of a rent overcharge. The DRA ruled for tenant but granted landlord a rent increase for a new stove installed in tenant's apartment. Tenant appealed, claiming that the stove was installed after she moved in and that she didn't sign any consent for a rent increase. The DHCR ruled for tenant. Tenant consent is required for 1/40th rent increases based on installations made during tenant's occupancy. The rent overcharge finding was recalculated to reflect removal of the stove rent increase.
