Tenant's Challenge to Landlord's Fuel Cost Report Untimely

Landlord filed a 2006 Fuel Cost Report with the DHCR. Rent-controlled tenant then filed a challenge to the report, claiming that she had inadequate heat. The DHCR ruled against tenant. Tenant didn't file her challenge to the Fuel Cost Report within 35 days after it was sent to her. So her challenge was untimely and must be dismissed. If tenant had insufficient heat, she could file a complaint with the DHCR.
