Landlord Proved 2002 Fuel Cost Report Was Filed on Time

The DRA revoked landlord's fuel cost increase for rent-controlled tenants for 2002. Landlord had previously obtained a fuel cost increase but didn't timely file a 2002 report of fuel price decrease. Landlord appealed and submitted proof that it had submitted the fuel price decrease report. Landlord showed a copy of the report and a certified mail receipt. The DHCR ruled for landlord. Landlord's proof of filing was sufficient, and no tenants answered in opposition.
