Tenant Violated Four Settlement Agreements

Landlord sued to evict tenant for chronic nonpayment of rent. Landlord and tenant signed a settlement agreement in court. Tenant failed to comply and continued to default on rent payments. Landlord and tenant signed three more agreements in response to tenant's requests to the court to delay execution of the eviction warrant. Landlord wouldn't agree to a fifth delay of execution of the eviction warrant requested by tenant. The court ruled for tenant. Landlord appealed and won. Tenant had a long history of rent defaults, both before and during the chronic nonpayment proceeding. Tenant offered no believable explanation for his latest default in payment of April 2007 rent. Landlord's agreement to sign several agreements in court extending tenant's time to pay didn't mean tenant could ignore his responsibility to pay rent.
