Tenant Returned Signed Renewal Offer 12 Days Late

Landlord sued to evict rent-stabilized tenant for not renewing her lease on time. Under the Tenant Protection Regulations, tenant must return the renewal lease within 60 days after a renewal offer is sent. Tenant returned the lease 12 days late. Her husband, the named tenant, had died, and she hadn't opened his mail right away. She had lived in the apartment with her husband for 19 years. Tenant asked the court to dismiss the case without a trial. The court ruled against tenant. A trial was needed to decide if there was an excusable default by tenant.
