Tenant Restored to Possession

Landlord sued to evict rent-stabilized tenant for nonpayment of rent. The court ruled for landlord, and tenant was evicted. Tenant then asked the court to restore him to possession. Tenant was prepared to pay all back rent, attorney's fees, and eviction costs. The court ruled for tenant. Landlord appealed and lost. There was minimal harm to landlord, and tenant would have been harmed by being evicted.
