Tenant Responsible for Maintaining Equipment He Installed

Landlord allowed tenant to combine three apartments into one and install his own fixtures and equipment. Tenant later demanded that landlord make repairs to the fixtures and equipment. Landlord asked the DHCR if it was required to do this. Landlord had offered to pay tenant for the equipment and fixtures if tenant would agree to a 1/40th rent increase, but tenant refused to do so. In an opinion letter, the DHCR said that tenant was responsible for making repairs to any equipment or fixtures that tenant installed and for which he didn't pay a rent increase to landlord.
