Tenant, Represented by an Attorney, Can Withdraw His PAR of DHCR Order

Rent-stabilized tenant complained to the DHCR of rent overcharge. The DRA ruled against tenant, who then filed a Petition for Administrative Review (PAR). Later, by letter from tenant's attorney, the tenant withdrew his PAR with prejudice. Pursuant to Rent Stabilization Code Section 2520.13, "where a tenant is represented by counsel, a tenant my withdraw, with prejudice, any complaint pending before the DHCR. Therefore, the DHCR accepted tenant's withdrawal and terminated the PAR proceeding.
