Tenant Proved Master Antenna Previously Provided

Tenant complained of a reduction in services. She claimed that landlord no longer provided a master television antenna, which was a base date service. Landlord claimed that no master antenna was ever provided. The DRA ruled for tenant, and landlord appealed. The DHCR ruled against landlord. A hearing had been held before the DRA. Tenant believably testified that, until August 1986, she had a TV antenna outlet in her wall that provided master antenna service. Other tenants submitted sworn statements that the service was previously provided.

Also, landlord's management company had sent out a notice in 1990 stating that the master antenna was removed from the building roof for roof work. So there was sufficient proof to support the finding that the master TV antenna was a required service.
