Tenant Didn't Sign Off on Work Order

Tenant complained of a reduction in services based on leaks in the apartment's bathroom and bedroom ceilings. The DRA ruled for tenant and reduced his rent. Landlord appealed and submitted a work order that tenant signed. On the form there was a typewritten statement that tenant withdrew his complaint because work was completed. The DHCR ruled against landlord. First, landlord submitted the signed work order after the DRA issued its order.

Landlord appealed and submitted a work order that tenant signed. On the form there was a typewritten statement that tenant withdrew his complaint because work was completed. The DHCR ruled against landlord. First, landlord submitted the signed work order after the DRA issued its order. Second, tenant signed only the part of the form stating ''work needed.'' He didn't sign his name next to the portion of the form stating ''work completed.'' Finally, an inspection showed that there was substantial moisture, mold, and mildew in the areas of the ceiling leaks. The DRA properly reduced tenant's rent.
