Tenant Denied Access for Repairs
LVT Number: 19188
(Decision submitted by James R. Marino of the Manhattan law firm of Kucker & Bruh, LLP, attorneys for the landlord.) After tenant complained of a reduction in services, the DRA reduced his rent. Landlord later applied for rent restoration and lost. The DRA found that not all of the services had been restored. Landlord appealed and won. Landlord claimed that tenant didn't allow access to complete the repairs. U.S. Postal Service Web site records showed that two certified letters from landlord were delivered to tenant. And tenant didn't deny that landlord had tried to schedule the repairs.
