Tenant Claims Landlord Damaged Her Linoleum

Tenant complained of reduced services because landlord had damaged the linoleum in her kitchen. An inspection verified the condition, so the DRA reduced tenant's rent. Landlord appealed, arguing that tenant installed the linoleum herself, so it wasn't a required service. Tenant claimed that she installed the linoleum because landlord refused to repair the kitchen floor. The DHCR ruled for landlord. Tenant can't get a rent reduction under the Rent Stabilization Code because landlord damaged her property. Tenant must sue landlord in court to pursue a claim for damages. If tenant installed the linoleum because landlord wouldn't repair a defective floor, tenant should have filed a complaint about the condition of the floor
