Tenant Claims Building Had Broken Front-Door Lock

LVT Number: 11578

Tenant sued landlord for negligence after her daughter was murdered in their apartment. Tenant claimed that landlord didn't provide a proper working lock for the building's front door. She claimed this was how attackers entered the building. Landlord claimed that the two attackers were guests of another building tenant and asked the court to dismiss the case without a trial. The court ruled against landlord, and landlord appealed. The appeals court again ruled against landlord. Tenant raised an issue of fact and could pursue her claim against landlord.
