Tenant Cancelled Scheduled DHCR Inspection

Rent-stabilized tenant complained of a reduction in services. The DRA terminated the proceeding and dismissed the complaint because tenant failed to provide access to the DHCR's inspector for physical inspection. Tenant appealed and lost. Tenant disputed the DHCR's finding that tenant cancelled a DHCR inspection on Aug. 27, 2019, one day before the scheduled inspection. But the DRA correctly relied on its file records showing that tenant had cancelled the inspection. Landlord also responded that tenant didn't provide access for repairs at different times during HPD and DHCR inspections. Landlord also claimed that the conditions in question in tenant's complaint had been corrected.
