Sweeping Every Two Hours Is Enough

The DOS issued a violation to landlord for not cleaning 18 inches into the street on two separate days. Landlord pointed out that the building contained a medical clinic and that the area was heavily trafficked. Landlord claimed that sweeping was done every two hours starting at 8 a.m. The ALJ found that landlord hadn't made the special efforts needed to keep the area in front of the building clean. Landlord was fined $100. Landlord appealed, and the ECB's appeals unit reversed. Landlord made reasonable efforts to clean in front of the building.
