Sidewalk Shed Not Required

DOB issued a violation notice to landlord for not putting up a sidewalk shed during construction work. Landlord argued that no sidewalk shed was required. The ALJ ruled against landlord. Landlord appealed and won. The building was 43 feet tall and the window lintel work being done was 38 feet from the ground. Since the repair work was being done at a height of less than 40 feet, no sidewalk shed was required under applicable regulations.
