Broken Sidewalk Shed Lights

DOB issued a violation notice to landlord for not providing lights in a sidewalk shed surrounding the building. Landlord claimed that it provided the lights, but that they were continually vandalized by homeless people using the shed as a shelter. The ALJ ruled for landlord and dismissed the violation. DOB appealed, pointing out that city regulations state that sidewalk shed lighting must be inspected nightly and that any burned-out or missing lightbulbs must be replaced immediately. ECB ruled for DOB. Landlord didn't show that it had inspected the lighting or replaced any missing lightbulbs on the night before the DOB inspection. Landlord was fined $2,000.
