Sidewalk Resurfacing Doesn't Qualify

Landlord applied for MCI rent hikes based on a number of improvements. The DRA ruled for landlord in part, but disallowed any increase for repaving the courtyard and sidewalks around the building. Landlord appealed and lost. Most of the concrete work was done to sidewalks outside the property line. And the resurfacing of a sidewalk isn't required for the operation, maintenance, and preservation of the building.
