Roof Damage Caused by Antenna

DOB issued a violation notice to landlord for not maintaining the building's roof. The violation notice stated that landlord didn't maintain a pole and antenna, which caused water damage to the roof and top-floor tenant's apartment. Landlord claimed he wasn't responsible for the antenna, which had been installed without his knowledge by a neighbor. Landlord had removed the antenna after the violation was issued. The ALJ ruled against landlord and fined him $800. Landlord appealed and lost. Landlord's own proof showed that he'd discovered the antenna and the damage it caused a year before he removed it.
