Landlord Didn't Prove Litter Caused by Windy Conditions

DOS issued a violation notice to landlord for having a dirty sidewalk area in front of the building. Landlord claimed that he cleaned frequently but that it was windy that day and trash was scattered. The ALJ ruled against landlord and fined him $50. Landlord appealed and lost. Landlord is responsible for keeping the area clean. And the violation notice stated that some of the litter was matted down. This couldn't have been caused by wind.
