Resurfacing of Parking Lot Qualifies

Landlord applied for MCI rent hikes based on the resurfacing of the building's parking lot. The DRA ruled against landlord, finding that the work was repair work, not a major capital improvement. Landlord appealed and won. Landlord resurfaced the entire original area of the parking lot within the property lines. This qualified as an MCI.
