Replacement of Roof Skylights

Landlord asked the DHCR if the replacement of 22 roof skylights, at a cost of $100,000, would qualify as an MCI. In an opinion letter, the DHCR stated that skylight replacement is considered maintenance or repair work and wouldn't qualify as an MCI. However, when skylight replacement is done in conjunction with a qualifying MCI, such as roof replacement, the DHCR has included the cost as part of the MCI.
