Replacement of Balconies and Terraces

Landlord applied for MCI rent hikes based on the replacement of building balconies and terraces. The DRA ruled against landlord, and landlord appealed. Some tenants responded. They claimed that since not all apartments had terraces or balconies, it was unfair to make all tenants pay for the improvement. The DHCR ruled for landlord. All balconies and terraces were replaced, so the work constituted an MCI. The work helped the structural soundness of the whole building, so the MCI rent hike would be passed on to all tenants.
