Replacement of 7 Out of 11 Gas Lines Doesn't Qualify

Landlord applied for MCI rent increases. Landlord replaced the gas line to the building and to seven of the 11 apartments in the building. The DRA ruled against landlord and landlord appealed. Landlord claimed the DHCR granted MCI increases for new water lines and electrical wiring, so it wasn't fair to deny an increase for a new gas line. The DHCR ruled against landlord. Landlord replaced lines in only seven out of 11 apartments. So the improvement wasn't building-wide.
