Rent Hike Granted for Fuel Storage Tank

Landlord applied for MCI rent hikes based on installation of a new fuel storage tank. The DRA ruled for landlord. Tenant appealed, claiming that heat and hot water service were inadequate since the installation of the new unit. The DHCR ruled against tenant. No tenants had filed heat or hot water complaints with the DHCR. Tenant himself had filed no such complaint claiming a reduction in services. Tenant was free to file a service reduction complaint, but there was no grounds to revoke the MCI rent hike.
