MCI Rent Hike Granted for New Fuel Tank

Landlord applied for MCI rent hikes based on the installation of a fuel storage tank. The DRA ruled for landlord. Tenant appealed, claiming that not all the work done qualified as an MCI. The DHCR ruled against tenant. Landlord installed a new fuel storage tank, and abandoned the old underground tank, as part of a single, unified project. There was no proof that any of the work was unnecessary for the properly completed project.
