Renovation Work

Tenant complained of a rent overcharge. The DRA ruled for tenant. Tenant appealed, claiming that there was an additional overcharge. Tenant said that there should be no rent increase for work done in the apartment before he moved in. The DHCR ruled against tenant. Landlord installed new hot and cold water feed lines in the bathroom, a new shower body and waste lines, retiled the bathroom wall and floors, grouted the entire area, did electrical wiring work, and plastered all damaged areas. This was all renovation work for which a 1/40th rent increase was proper.
