Bathroom Renovations

Tenant complained of a rent overcharge. The DRA ruled for tenant, and landlord appealed. Landlord had submitted proof of apartment renovations to the DRA. Landlord's documents were misfiled. The DHCR allowed landlord a rent increase for bathroom renovations, including replacement of the toilet and installation of a shower and necessary piping and fittings. The DHCR disallowed any increase for window repairs, plastering, painting, and putting new tile on the bathroom floor and walls. These were considered maintenance and repair items.
