Regular Extermination Services Not Enough

Rent-controlled tenant complained of a reduction in services. The DRA reduced tenant’s rent based on a vermin condition. Landlord later applied for rent restoration based on the restoration of services. The DRA ruled against landlord, who appealed and lost. Landlord’s proof of regular extermination services didn’t prove that the services provided were adequate and effective in eradicating the roach infestation in tenant’s apartment or that the condition had been cured.

Landlord’s claim that tenant caused the condition by leaving cat food on the kitchen floor wasn’t proved, and landlord remained responsible for providing adequate extermination services.
