Reduced Space in Tenant's Apartment to Accommodate Mailbox Installation

LVT Number: 16887

Landlord asked for permission to decrease tenant's apartment space to accommodate a new mailbox installation. The DRA ruled for landlord on condition that tenant's rent was reduced permanently by $7.50 per month. Tenant appealed, claiming that another area of the building lobby could have been used and that she lost 24 cubic feet rather than five square feet. The DHCR ruled against tenant. An inspection showed that landlord's request was justified. There was no other suitable location in the lobby for the mailboxes. And tenant lost only about one foot of apartment space.

The cubic feet tenant referred to concerned the height and width of the installation, which didn't interfere with tenant's actual living space.
