Prior Landlord Removed Elevator Without Permit

DOB issued a violation notice to landlord for not maintaining an elevator. The violation was based on landlord's not filing and getting a permit for prior landlord's removal of an elevator. Landlord claimed that there was no failure to ''maintain'' an elevator. The ALJ and ECB agreed and dismissed the violation. Merely not filing the work permit, with no proof that the elevator had been removed unsafely, didn't constitute a failure to maintain the elevator.
