Prior DHCR Order Covered Same Period

Tenant complained of a rent overcharge. The DRA ruled for tenant, and landlord appealed. Tenant had previously filed an objection to his initial 1984 rent registration, which included an overcharge claim. The DRA had ruled that there was no overcharge and had denied tenant's PAR of that order. The prior case covered the same tenancy and time period. The DHCR ruled for landlord. The DHCR's prior decision was binding, and the new finding of overcharge must be revoked.
