Number of Months of Overcharge Miscalculated

Yonkers tenant complained of a rent overcharge. The DRA found that tenant had been overcharged from Aug. 1, 1981, through Oct. 10, 1983, and awarded 28 months back rent. Landlord appealed, and the DHCR reduced the overcharge award. The DRA had miscalculated the number of months tenant had been overcharged. The period from Aug. 1, 1981, through Oct. 31, 1983, is only 27 months.
