No Rent Cut for Recurring Condition

Tenant complained of reduced services, based on defective kitchen linoleum. The DRA reduced tenant's rent, and landlord appealed. Landlord claimed that the issue of tenant's kitchen linoleum was already the basis of two rent reduction orders in 1989. Since then, the DRA had granted landlord's application to restore rent for replacing the linoleum. The DHCR found that the new complaint related to a condition that had since been repaired. The DHCR granted landlord's PAR and revoked the rent cut.
