No MCI Rent Hike for Piecemeal Parapet Wall Replacement

Landlord applied for MCI rent hikes based on claimed masonry, parapets, roof railing, lintels, window sills, pointing, and waterproofing. The DRA ruled against landlord, finding that the work was piecemeal repair and maintenance work. Landlord appealed and lost. Landlord claimed that the entire parapet wall was replaced. But landlord's contract dated January 2004 listed 132 linear feet of parapet work to be done for a specified cost. Landlord's application claimed that 323 linear feet of parapet work was done at a much higher cost.

The additional parapet work wasn't supported by change orders or other proof to show that it was done with the 2004 work as part of a unified and consecutively timed project. Landlord didn't claim any financial hardship that might justify an extended period of time to complete work.
