No MCI Rent Hike for Partial Courtyard Replacement

Landlord applied for MCI rent hikes based on courtyard pavement resurfacing. The DRA ruled against landlord, who appealed and lost. Documentation submitted by landlord showed that the courtyard at the rear of the building was partially resurfaced and that the work included repair of certain areas of concrete. To qualify as an MCI, concrete resurfacing of courtyards must include the entire original courtyard area and the walkways within the property lines of the building. Landlord's work didn't qualify.
