No MCI Increase for Leaking, Bubbling Roof

Landlord applied for MCI rent hikes based on the installation of a new roof and vestibule entrance door. The DRA ruled for landlord. Nine tenants appealed and won, in part. Tenants claimed that landlord merely repaired the roof, and in an unworkmanlike manner. They also claimed that the new vestibule door didn't align properly and didn't have a lock as the old one did. DHCR inspection showed that, although landlord did install a new roof, there was leak damage to ceilings and walls in the bulkhead in the public hallway.

DHCR inspection showed that, although landlord did install a new roof, there was leak damage to ceilings and walls in the bulkhead in the public hallway. There also was standing water on the roof and leak damage in at least one apartment. In light of the leaking and bubbling on various areas of the roof, the DHCR revoked the MCI increase for the roof installation. The DHCR upheld the MCI increase for the vestibule door since it worked properly. Tenants could file a complaint based on reduction in services concerning the lack of a lock on the vestibule door.
