Roof Leaks Unrelated to Pointing Work Don't Bar MCI Rent Hike

Landlord applied for MCI rent hikes based on pointing and waterproofing at the building. The DRO ruled for landlord and increased tenants’ rents. One tenant appealed, claiming that she had leaks damaging her kitchen and living room ceilings. The DHCR ruled against tenant. Tenant claimed that the leaks were caused by roof conditions. But any leaks from the roof were unrelated to the pointing and waterproofing work that didn’t involve the building roof.
