No Increase for Repair Items

Tenant complained of a rent overcharge. The DRA ruled for tenant and ordered a rent refund. Landlord appealed, claiming that the DRA should have allowed a rent increase for certain apartment improvements made before tenant moved in. The DHCR ruled that the DRA properly disallowed a rent increase for certain repair and maintenance items, including the installation of a smoke alarm, storm door, light fixtures, and lock cyclinder.
