No Increase for Exterior and Emergency Lighting

Landlord applied for MCI rent hikes based on the installation of new exterior and emergency lighting. The DRA denied landlord's application, and landlord appealed. Landlord claimed the installation was done to decrease energy costs. The DHCR ruled against landlord. The installation of exterior and emergency lighting doesn't qualify as an MCI without electrical upgrading of the entire building because it isn't required for the operation, preservation, and maintenance of the structure, nor does it add to the building's value.
