No Increase for Defective Windows

Landlord applied for MCI rent hikes, based on the installation of new windows building-wide. A DHCR inspector found defective windows in 15 apartments, so the DRA ruled for tenants. Landlord appealed, and lost. Follow-up inspections showed that over 50 percent of the apartments still had defective windows, more than eight years after landlord had filed its original MCI application. Also, 19 building violations for the window conditions were still outstanding. So, landlord isn't entitled to a rent hike.
