Tenant complained of a rent overcharge. The DRA ruled for tenant. Among other things, the DRA disallowed any rent increase for the installation of new vinyl tiles in the kitchen. Landlord appealed, claiming this was an individual apartment improvement for which landlord could get a 1/40th rent increase. The DHCR ruled against landlord. This type of work was considered a repair and/or maintenance item, not an improvement.
