New Roof Qualifies Despite One Leak

Landlord applied for MCI rent hikes based on the installation of a new roof. The DRA ruled for landlord. Tenant appealed, claiming that there was a leak from the new roof into one apartment. The DHCR ruled against tenant. The DRA already ruled that the one tenant with the leak was exempt from the MCI rent hike. Otherwise, there was no reason to bar the MCI rent hike.
