Mold Remediation Was Done in Unworkmanlike Manner

Rent-stabilized tenant complained of a reduction in services in August 2015 due to mold and mildew in the apartment and needed painting. The DRA ruled for tenant and reduced her rent. Landlord appealed and lost. Inspection conducted in April 2016 found mold in the bedroom and bedroom closet. Paint throughout the apartment appeared old and faded. Landlord claimed that tenant had signed off on mold remediation and that the DHCR’s inspection, four months later, shouldn’t be considered since the mold finding was based on a new condition.

But any mold remediation that may have been performed was unworkmanlike. And, while landlord claimed that tenant wanted painting put off until after the December 2015 holiday season, this didn’t explain why painting still wasn’t done four months later.
