Mismatched Tile Colors and Gloss

LVT Number: 10659

The DRA reduced tenant's rent based on a reduction in services. Landlord applied for rent restoration. The DRA ruled for landlord, and tenant appealed. Landlord had been directed to replace bathroom tiles in tenant's apartment. Tenant claimed that the replacement tiles weren't the same color as the existing tiles and that only one set of tiles contained a high gloss. The DHCR ruled against tenant. Any difference in the tile colors was de minimus and didn't warrant a rent reduction.
