Miscellaneous Effective Date of Labor Cost Rent Increase Delayed

In December 2001, landlord applied for a labor cost adjustment increase to the maximum collectible rents for rent-controlled tenants. The DRA ruled for landlord in April 2005. The DRA's order stated that the effective date of the rent increase was May 1, 2005. Landlord appealed and lost. Landlord claimed that the effective date should be March 1, 2002, because the DRA delayed its ruling on landlord's application. The DHCR stated that rent control regulations provide that the effective date of this type of rent increase is the next rent payment date after the DRA order is issued.
